As of November 19, 2024, amendments to the Civil Code of the Republic of Belarus (hereinafter referred to as the Civil Code) shall enter into force. These amendments stipulate that, in cases of non-performance or improper performance of a monetary obligation, it shall no longer be possible to recover both a penalty and interest for the use of another person's funds simultaneously. An exception applies to cases where the simultaneous recovery of a penalty and interest is provided for by law (paragraph 3-1 of Article 366 of the Civil Code).<\/p>\n\n\n\n
Consequently, from November 19, 2024, the extent of liability for individuals who have breached a monetary obligation will be reduced. Nevertheless, the parties may agree on a different interest rate than that provided for by the Civil Code.<\/p>\n\n\n\n
